We’ll meet twice by Zoom in advance of the conference to provide an overview of the applicable law and teach the legal framework that applies to cases brought pursuant to 42 USCSec. 1983 against child welfare workers and child welfare agencies. This should be adequate to prepare you to participate in a meaningful way in the live course.
We’ll address how to structure your complaint and discovery, including how to weave your version of the facts and law into trial focused depositions. We’ll also talk about the availability of attorney’s fees and how to secure them, as well as settlement strategies to maximize the value of your client’s case. We will spend the afternoon providing you with examples regarding application of the concepts outlined below to real cases we are currently prepping for trial.
Course Objectives:
1) Use case specific examples to illustrate application of law to the three main types of claims:
A. Unwarranted Seizures/Medical Procedures
B. Deceptive Presentation of Evidence in Juvenile Proceedings
C. Injuries to Foster Children in County Custody
2) Use case specific examples to illustrate how to conduct trial focused depositions to be used at trial in lieu of live testimony
A. Unwarranted Seizures/Medical Procedures
B. Deceptive Presentation of Evidence in Juve Proceedings
C. Injuries to Foster Children in County Custody
3) Use case specific examples to illustrate how to create evidence that constitutes a Plaintiff centered statement of black letter law
A. Unwarranted Seizures/Medical Procedures
B. Deceptive Presentation of Evidence in Juve Proceedings
C. Injuries to Foster Children in County Custody
4) Use case specific examples to illustrate how to wrap all of the above into a per se Monell claim through the use of Requests for Admission at trial

B. Deceptive Presentation of Evidence in Juve Proceedings
C. Injuries to Foster Children in County Custody
